By visiting our website, submitting an enquiry, or booking a programme, you agree to be bound by these terms. If you do not agree, please discontinue use of our website and services immediately.

1. About Holisticbrightkn

Holisticbrightkn is an Australian-based provider of on-site exercise programmes designed specifically for office workers. Our services include the Desk Reset Session, Weekly Movement Plan, and Office Flow Workshop, delivered at client workplaces across Victoria and surrounding regions. 2. Acceptance of Terms

By accessing holisticbrightkn.world, creating an enquiry through our contact form, or entering into a service agreement with Holisticbrightkn, you confirm that you are at least eighteen years of age, have the legal authority to bind yourself or the organisation you represent, and accept these Terms of Use in full. If you are acting on behalf of a company or organisation, you warrant that you have authority to accept these terms on its behalf.

3. Website Use

You may use our website for lawful purposes related to learning about and booking our office exercise services. You agree not to use the website in any manner that could damage, disable, overburden, or impair our servers or networks; attempt to gain unauthorised access to any part of the website, other accounts, or computer systems; use automated tools such as bots or scrapers to extract data without our prior written consent; transmit viruses, malware, or other harmful code; or impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. Service Bookings

All exercise programme bookings with Holisticbrightkn are subject to availability and confirmation. Submitting a contact form or enquiry does not constitute a confirmed booking. A booking is confirmed only when you receive written confirmation from our team, including agreed dates, programme details, participant limits, and pricing. You are responsible for providing accurate information regarding team size, office location, accessibility requirements, and any relevant workplace policies that may affect session delivery.

5. Pricing and Payment

All prices displayed on holisticbrightkn.world are in Australian Dollars and include GST where applicable unless otherwise stated. Current programme pricing includes the Desk Reset Session at AUD $89, the Weekly Movement Plan at AUD $249 per month, and the Office Flow Workshop at AUD $450. Holisticbrightkn reserves the right to modify pricing at any time, but confirmed bookings will be honoured at the price agreed at the time of confirmation. Payment terms will be communicated in your booking confirmation and must be settled according to the agreed schedule.

6. Cancellation and Rescheduling

Clients may reschedule a confirmed session with at least forty-eight hours notice at no additional charge, subject to coach availability. Cancellations made with less than forty-eight hours notice may incur a cancellation fee equivalent to fifty percent of the session cost. Cancellations made with less than twenty-four hours notice or no-shows may be charged the full session fee. For monthly programmes, please refer to our Return Policy for detailed cancellation terms. Holisticbrightkn reserves the right to cancel or reschedule sessions due to coach illness, severe weather, or circumstances beyond our reasonable control, in which case we will offer an alternative date or a full refund for the affected session.

7. Participant Responsibilities

Participating employees are responsible for disclosing any physical conditions, injuries, or limitations that may affect their ability to safely perform exercises. While our coaches provide modifications for varying fitness levels, participants engage in sessions at their own discretion and should stop any activity that causes pain or discomfort. The client organisation is responsible for providing adequate space for sessions, ensuring the area is free from hazards, and communicating any workplace health and safety requirements to our coaching team prior to the session date.

8. Intellectual Property

All content on holisticbrightkn.world, including text, graphics, logos, exercise programme structures, session guides, photographs, and software, is the property of Holisticbrightkn or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission. Printed materials provided during sessions may be used internally within your organisation but may not be redistributed or sold to third parties.

9. Disclaimer of Warranties

Our website and services are provided on an as-is and as-available basis. To the fullest extent permitted by Australian law, Holisticbrightkn disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of viruses. Our exercise programmes are designed to support general workplace wellness and mobility. They are not a substitute for personalised professional advice. Individual results may vary based on participation level, existing physical condition, and workplace environment.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Holisticbrightkn, its directors, employees, coaches, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or participation in our exercise programmes. Our total aggregate liability for any claim arising from or related to these terms or our services shall not exceed the amount you paid to Holisticbrightkn for the specific service giving rise to the claim during the twelve months preceding the event. Nothing in these terms excludes liability that cannot be excluded under the Australian Consumer Law.

11. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to meet a consumer guarantee. Rights under the Australian Consumer Law are in addition to any rights expressed in these Terms of Use and our Return Policy.

12. Indemnification

You agree to indemnify, defend, and hold harmless Holisticbrightkn and its officers, employees, and coaches from any claims, damages, losses, liabilities, and expenses arising from your breach of these terms, your misuse of our website, inaccurate information provided during booking, or failure to disclose relevant participant health information to our coaching team.

13. Governing Law

These Terms of Use are governed by the laws of the State of Victoria, Australia. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Victoria. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
